AGREEMENT

 

This is an agreement between you and Spectrum Sciences, Inc. (the Service Provider) for our High Speed Internet Service (the Service).   By establishing an account or using the Service or equipment, you agree to be bound by this Agreement and to use the Service in compliance with the Service Provider’s Service Agreement.

 

II.    TERM

           

The initial term of this agreement is (30) days from the date that the Service is first used (“Activation Date”) and will continue on a month-to-month basis.  Spectrum Sciences, Inc. reserves the right to change the price of the Service at any time after the initial term upon (30) days notice. 

 

III.  SERVICE AGREEMENT

 

By ordering and using the Service, you and all members of your household, business, or guests agree to be bound by the terms and conditions of the Service Agreement.  Spectrum Sciences reserves the right to change, modify, add or remove portions of this agreement at any time.  Notice of changes to the agreement will be made via your current e-mail address on file.  Continued use of the Service indicates your acceptance of the terms and conditions of the Service Agreement.

 

IV.   THE SERVICE

           

        The service includes:

·         Wireless Internet access and usage of certain related equipment

·         Four POP mailbox or mail forwarding

 

The Service speed can vary depending on location, weather, line quality, inside wiring, Internet traffic, and other factors beyond the control of Spectrum Sciences.  Spectrum Sciences does not guarantee upload or download speeds.

 

The Internet service is available under this agreement after the Activation Date.  Spectrum Sciences is not responsible for any long-distance, toll or international, and simultaneous login access cost will be extra.

 

Technical support is available via e-mail and phone during normal business hours – Monday through Friday, 8AM to 5PM.

 

V.  USE OF THE SERVICE

 

You agree not to use the Service for any illegal, fraudulent or abusive purpose.  You agree not to use the Service to achieve unauthorized access to any computer systems, software, data, or other copyright protected material.

 

VI.  NO RESALE OR USE OUTSIDE OF ACCOUNT

 

You agree not to resell and/or distribute the service to any party outside of your residence or business.

 

VII. CANCELLATION

           

If you are dissatisfied with the Service or any related terms, conditions, rules, policies, guidelines, or practices, you are responsible for scheduling an appointment with Spectrum Sciences for an uninstall.  If you choose to cancel service in the middle of the month, you will be charged for the balance of that month.  To cancel the Service with Spectrum Sciences, you must call 301-862-1993 or write to Spectrum Sciences, Inc., Customer Service Manager, 44425 Airport Road, Suite 160, California, MD 20619 at least two weeks prior to the cancellation of service date.

 

 

 

ACCOUNT REQUIREMENTS

 

In order to receive this Service:

               

·         You must be at least 18 years old.

 

For PC:

           

·         333 MHz or faster Pentium II processor (or equivalent)

·         Windows 98SE/2000/ME

·         32MB RAM

·         120MB of available hard disk space

·         Installed CD-ROM drive

·         USB Port or Ethernet Port

 

 

 

VIII.            PAYMENT

 

You will be charged a one-time installation fee, hardware fee (if required) and a monthly charge for the Service.  You must provide accurate billing information including legal name, address, telephone number, and credit card/billing information, and report all changes to this information immediately.  You are responsible for any charges to an account.  Questions regarding charges to an account should be directed to our Customer Service Department at 301-862-1993 ext. 141.  All charges are considered valid unless disputed in writing within (60) days old.

 

Charges will be billed via a monthly statement.  Spectrum Sciences, Inc. is not responsible for any charges or expenses (e.g., for overdrawn accounts, exceeding credit card limits, etc.) resulting from charges billed by Spectrum Sciences, Inc.  You agree to keep your account in good standing.

 

In most cases, your account plan can be changed at any time with a simple phone call and does not require a site visit.

 

 

IX.                YOUR ACCOUNT, PASSWORD AND SECURITY

 

Upon registration, you will receive a username, password and account designation.  You are solely responsible for use of the Service.  Email accounts exceeding 10MB in size may be inactivated until you reduce the size of the mail being stored. 

 

X.                   INSTALLATION

 

Because the equipment is highly sophisticated and FCC regulations for installing and pointing the antenna are very stringent, a certified installation technician must professionally install the equipment on the property and uninstall equipment when terminating service.  A scheduled appointment should be made for both instances.

 

Standard installation includes mounting of the necessary antenna and equipment and a cable run to be terminated at one location within the structure as specified by the subscriber.  The location of the cable run shall be accessible by reasonable means.  From the cable terminating location, the cable will be connected to the device of the subscriber’s choosing which may include a PC, router, or other Ethernet capable device and assistance will be given to properly connect the device to the SoMD Wireless Network.  The connection of additional devices or any additional cable runs are the responsibility of the subscriber.  Spectrum Sciences, Inc. will perform any work requested beyond what is included in the standard installation at an hourly rate of $65/hour billed in 1 hour increments.  This work will be listed on a field report and a signature will be required.

 

It is specifically understood that the signal processing equipment which will be installed to connect the SYSTEM to the SERVICE shall remain the personal property of SPECTRUM SCIENCES, INC. SUBSCRIBER empowers SPECTRUM SCIENCES, INC. to remove the system equipment upon termination of this agreement. Customer’s name on the account will assume responsibility for the loss, theft, or damage of equipment (with the exception of weather damage) and will be charged $399.00. 

 

SUBSCRIBER has the option to purchase and own the equipment in lieu of paying an installation charge.  If purchased, SUBSCRIBER retains possession of equipment upon SERVICE termination.  SPECTRUM SCIENCES, INC. will not “buy back” purchased equipment.  SUBSCRIBER is solely responsible for loss, theft or damage of equipment.

 

If SUBSCRIBER moves to a different location, there will be a one time fee of $75 assessed to move the signal processing equipment to the new location.
